It can be stressful when an Enforcing Officer chooses to investigate a business. How do the HSE decide when to come and get involved?
First of all, a business must report to the HSE when certain accidents or near misses occur under the RIDDOR regulations.
Where a business reports someone has died as a result of work, this must be investigated.
In addition, a business should expect to be investigated if any of the following should happen:
Suffocation.
Loss of consciousness head injury.
Significant burn / scalding.
Internal injury crushing incident.
More than one fracture.
Severed hand or foot.
Blinding or scalping.
Any business which expects to be investigated should consider working with legal advisers so that an Accident Investigation might be conducted under privilege.
