August 2011 - Is 'Environmental' the new health & safety?
The new coalition Government has signalled that they want a more practical approach to health and safety. There are signs of things getting better. But some might say “environmental” is the new terror for the hard-working employer.
All organisations have a duty of care to ensure that their activities do not have a negative impact on the natural environment. Are the Regulations incomprehensible? Is it policed overzealously?
Over the next few months our inhouse environmental, Craig Beaumont, will be writing a monthly feature for our newsletter covering environmental issues.
Here, Craig highlights the Environmental Permitting Regulations 2010.
The Regulations replaced earlier rules governing pollution prevention and control and waste management licensing. The current regulations have a wider scope and include water discharge and groundwater activities, radioactive substances and a number of EU Directives.
Whatever your business you need to know if the activity you carry out is covered by the Regulations and therefore whether you need to register an exemption or apply for an environmental permit. If you need a permit you will also need to know whether it needs to be a standard or bespoke one.
If you were already operating under a permit from the previous regulations then you should be aware of the changes to the legislation and the effect that could have on you.
