June 2011 - Corporate Manslaughter appeal denied
The Court of Appeal has refused the application for leave to appeal on behalf of Cotswold Geotechnical Holdings against their conviction and the fine imposed in the first prosecution under the Corporate Manslaughter and Corporate Homicide Act.
The Lord Chief Justice said that the £385,000 fine imposed was appropriate and to limit a fine to the level which this company was capable of paying would have resulted in a “ludicrous” penalty.
This case serves as a reminder to businesses that if convicted under this Act they can expect to be severely punished.
